With little advance publicity (and seemingly little or no input from employers), Missouri voters passed one of three different Constitutional amendments making the use of marijuana and marijuana-derived products legal for certain medical purposes. It is too early to predict all of the ramifications of Article XVI for employers, but this session will identify the provisions particularly relevant to the employer-employee relationship; discuss developments under similar, earlier laws in other states; outline the interplay of this Amendment with the existing Missouri worker’s compensation and unemployment compensation statutes; and consider its effect on Missouri employer policies.
Shelly Freeman is a Principal at Jackson Lewis P.C., in Overland Park, Kansas. She has nearly 30 years’ experience practicing labor and employment law.
